Terms of Use
These Terms of Use govern your use of Gym Notes, operated by Herculean Labs LLC (Twelve Trials Software). By using Gym Notes you agree to these Terms and our Privacy Policy.
Accounts
An account is optional for core workout features and required for cloud AI Coach, subscriptions, and cloud backup. You are responsible for keeping your credentials confidential and for activity under your account.
Permitted use
Use Gym Notes only for lawful personal fitness tracking and coaching features. Do not attempt to disrupt the service, abuse AI Coach allowances, or access another person’s account.
AI Coach limitations
AI Coach may produce incomplete, incorrect, outdated, or unsuitable suggestions. Outputs are generated automatically and may not fit your equipment, injuries, experience, or goals. You must use your own judgment before changing training.
Fitness and health disclaimer
Strength training and exercise involve risk of injury. Gym Notes is not medical advice, diagnosis, treatment, emergency assistance, or a substitute for a qualified professional. Consult a physician or other qualified professional before starting or changing an exercise program, especially if you have health conditions, injuries, or pain. You are solely responsible for choosing safe weights, exercises, rest, and training decisions.
Intellectual property
Gym Notes software, branding, and related materials are owned by the operator or licensors. These Terms do not transfer ownership to you.
Your content
You retain rights to workout logs and other content you create. You grant us permission to host and process that content as needed to provide the features you use (including AI Coach and cloud backup).
Cloud backup
Cloud backup is provided on a best-effort basis. Backups may fail, become unavailable, or be incomplete. Keep important information under your own control. We do not guarantee restore success in every situation.
Service availability and changes
We may change, suspend, or discontinue features. We do not guarantee uninterrupted or error-free service.
Subscriptions and billing
Paid features may renew automatically until cancelled. Prices, billing periods, and taxes are displayed by Apple App Store or Google Play (via RevenueCat) at purchase time. Manage or cancel subscriptions through your Apple or Google account subscription settings. Deleting your Gym Notes account does not automatically cancel a store subscription. Refunds are handled according to Apple or Google policies.
Disclaimers
Gym Notes is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.
Limitation of liability
To the fullest extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or training progress, arising from your use of Gym Notes or reliance on AI Coach output. Our total liability for any claim relating to the service is limited to the greater of (a) the amounts you paid us for Gym Notes subscriptions in the twelve months before the claim or (b) zero if you paid nothing through us (store fees may still be governed by Apple or Google). Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum permitted by law.
Termination
You may stop using Gym Notes and delete your account at any time. We may suspend or terminate access if you violate these Terms or misuse the service.
Changes to these Terms
We may update these Terms. The effective date will change when updates are published. Continued use after an update constitutes acceptance.
